Conflicts of Interest reviews typical situations encountered by practitioners who close real estate transactions that involve possible conflicts of interest. Business referrals, issuing title insurance policies while representing one party, and conflicts between the parties into which the closing agent may be brought, are all discussed. The duties of a closing agent to the parties, including as a fiduciary and as a title insurance issuing agent, are also reviewed.
